Video Transcript:This is Jonathan Franco and I’m going to talk a little bit about what damages you have available to you in a workers comp case. A lot of folks want to make a claim for pain and suffering within a Mississippi workers comp case. Unfortunately, you cannot receive damages under Mississippi workers compensation for pain and suffering. So that’s completely off the table. What you can get it, if you’re being held out of work, you can get what’s called temporary total disability for the period of time during which you have a work excuse. You can also get damages for any sort of permanent injury that you have, if a doctor puts on you any sort of restriction or permanent impairment rating. And you can also get future medicals. Any sort of future medical that you may require is also a damage available to you in a worker’s comp case. And there’s also penalties that are available if an employer and carrier do not pay benefits that they are statutorily required to pay.
